1. Agreement to Terms

By accessing or using the FootFix website (footfix.co), placing an order, or engaging with any of our services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our website or purchase our products.

These Terms constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and FootFix (“we,” “us,” or “our”). By using this site, you represent that you are at least 18 years of age, or that you are using the site with the consent and supervision of a parent or legal guardian.

2. Products & Descriptions

We make every effort to display our products as accurately as possible. However, we cannot guarantee that your device’s screen will accurately reflect the actual color, texture, or dimensions of any product. Product images are for illustrative purposes and may vary slightly from the actual item received.

Product descriptions, including materials, features, and specifications, are provided in good faith based on information supplied by our manufacturers. Minor variations in color, size, texture, or design are inherent in the manufacturing process and do not constitute a defect or misrepresentation.

We reserve the right to modify, discontinue, or update any product listing at any time without prior notice.

3. Pricing & Availability

All prices are listed in US Dollars (USD) and are subject to change without notice. We reserve the right to correct pricing errors at any time, even after an order has been placed. In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel your order for a full refund.

Product availability is not guaranteed. If an item becomes unavailable after you place an order, we will notify you promptly and issue a full refund.

4. Orders & Payment

When you place an order, you are making an offer to purchase the product(s) at the listed price. We reserve the right to accept or decline any order for any reason, including but not limited to product availability, suspected fraud, or pricing errors.

Payment is processed at the time your order is placed through our third-party payment processors. We do not store your full credit card information on our servers. All transactions are encrypted and processed securely through Shopify Payments and/or PayPal.

By placing an order, you represent that the payment information you provide is accurate and that you are authorized to use the payment method.

5. Shipping & Delivery

Orders are processed within 1–3 business days. Estimated shipping times are 7–25 business days depending on your location. These are estimates only and are not guaranteed delivery dates.

Once your order ships, you will receive a confirmation email with tracking information. Please allow up to 48 hours for tracking details to update. FootFix is not responsible for delays caused by carriers, customs processing, weather events, natural disasters, or other circumstances beyond our control.

Risk of loss and title for items purchased pass to you upon delivery of the item to the carrier.

6. Refunds & Returns

Our complete Refund & Return Policy is available as a separate document on our website. By placing an order, you acknowledge that you have read, understood, and agreed to our Refund & Return Policy, which is incorporated into these Terms by reference.

7. Intellectual Property

All content on the FootFix website, including but not limited to text, graphics, logos, product images, page layouts, and software, is the property of FootFix or its content suppliers and is protected by United States and international intellectual property laws.

You may not:

•       Copy, reproduce, distribute, or create derivative works from any content on this site without our express written permission.

•       Use our trademarks, logos, or branding in any manner that suggests endorsement or affiliation without prior written consent.

•       Scrape, crawl, or use automated tools to extract data or content from our website.

8. User Conduct

When using our website, you agree not to:

•       Use the site for any unlawful purpose or in violation of any applicable local, state, national, or international law.

•       Attempt to gain unauthorized access to any portion of the website, other accounts, or any systems or networks connected to the website.

•       Interfere with or disrupt the website, servers, or networks connected to the website.

•       Submit false or misleading information, including during the order or account creation process.

•       Use the site to transmit any malicious code, viruses, or harmful data.

•       Place fraudulent orders or use stolen payment information.

We reserve the right to terminate your access to the website and cancel any orders if we determine, in our sole discretion, that you have violated these Terms.

We reserve the right to suspend or terminate accounts that we believe are being used fraudulently or in violation of these Terms.

Our payment processing, shipping, and certain site functionality are provided by third-party service providers, including Shopify. Your use of these services is subject to their respective terms of service.

11. Limitation of Liability

To the fullest extent permitted by applicable law, FootFix and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the website or purchase of products, regardless of whether such damages are based on warranty, contract, tort, or any other legal theory.

In no event shall our total liability to you for all claims arising out of or related to your use of the website or purchase of any product exceed the total amount you paid to FootFix for the specific product(s) giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

12. Disclaimer of Warranties

The FootFix website and all products are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any product will meet your specific expectations unless explicitly stated in the product description.

FootFix products are general wellness and comfort products. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a qualified healthcare professional for medical advice.

13. Indemnification

You agree to indemnify, defend, and hold harmless FootFix, its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the website; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your misuse of any product purchased from FootFix.

14. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the website, you agree to first attempt to resolve the dispute informally by contacting us at support@footfix.co. We will make good faith efforts to resolve any dispute within 30 days.

If the dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Florida, and you consent to the personal jurisdiction of such courts. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

15. Arbitration Agreement

To the fullest extent permitted by law, you and FootFix agree that any dispute, claim, or controversy that cannot be resolved informally shall be resolved through binding individual arbitration, rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration.

Arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) and shall take place in the State of Florida. The arbitrator’s decision shall be final and binding.

You acknowledge that by agreeing to these Terms, you are waiving your right to a trial by jury and your right to participate in a class action.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Entire Agreement

These Terms, together with our Refund & Return Policy and Privacy Policy, constitute the entire agreement between you and FootFix regarding your use of the website and purchase of products, and supersede all prior agreements, communications, and understandings, whether written or oral.

18. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
